Reformer Infinity - FZCO is referred to in these Terms and Conditions as “Reformer Infinity”, “we”, “us” or “our”.
By placing an order through the online store, the customer agrees to these Terms and Conditions.
Nothing in these Terms limits or excludes mandatory consumer rights that cannot legally be excluded.
1. Scope
These Terms and Conditions apply to the online sale of:
Pilates reformers;
Pilates equipment;
reformer accessories;
replacement parts;
Pilates accessories;
fitness accessories;
related physical products
sold through the Reformer Infinity online store.
The store sells to customers in selected international markets, including countries within the European Union and European Economic Area and the Kingdom of Saudi Arabia.
Additional mandatory consumer rights may apply depending on the customer's country of residence and delivery destination.
Where these Terms conflict with mandatory consumer law applicable to a consumer, the mandatory consumer law takes precedence.
2. Consumers and Business Customers
A consumer is an individual purchasing primarily for purposes outside a trade, business, craft or profession.
Customers purchasing primarily for commercial or professional purposes, including Pilates studios, gyms, hotels, fitness centres, rehabilitation facilities, trainers, resellers or other businesses, may be considered business customers.
Statutory consumer rights described in these Terms apply only where the purchaser qualifies as a consumer under applicable law.
Any product-specific commercial warranty may contain different conditions for professional or commercial use. Such conditions do not reduce mandatory statutory rights available to consumers.
3. Product Information
Reformer Infinity takes reasonable steps to ensure that product descriptions, specifications, dimensions, photographs, colours, materials and other product information displayed on the website are accurate.
Product photographs are illustrative. Minor differences in colour, texture, finish or appearance may occur because of:
manufacturing variations;
natural material variations;
lighting;
photography;
screen settings;
production batches.
Product measurements and weights may be subject to reasonable manufacturing tolerances.
The main characteristics of each product are stated on the relevant product page.
Customers should carefully review dimensions and specifications before ordering.
4. Access Requirements for Pilates Reformers
Pilates reformers are large and heavy products.
Before purchasing a reformer, the customer should verify that the product can be safely transported into the intended location.
This includes checking, where relevant:
entrance widths;
door widths;
corridors;
stairways;
lifts;
access routes;
ceiling heights;
room dimensions;
available installation space.
Unless expressly included in the purchased delivery service, Reformer Infinity is not responsible for measuring or assessing access to the customer's premises before delivery.
Additional delivery or handling costs caused by incorrect access information supplied by the customer may be charged where legally permitted.
5. Placing an Order
Products displayed on the website represent an invitation to place an order.
The customer places an order by completing the checkout process and selecting the button that confirms the obligation to pay.
Before submitting the order, the customer is given the opportunity to review and correct the information entered during checkout.
The customer is responsible for ensuring that:
contact information is accurate;
the delivery address is complete;
billing information is correct;
the selected products and quantities are correct.
6. Formation of the Contract
After an order is placed, Reformer Infinity may send an automated acknowledgement or order confirmation.
A purchase contract is concluded when the order is accepted by Reformer Infinity, including through an order acceptance confirmation or dispatch of the products.
Reformer Infinity may refuse or cancel an order before acceptance where there is a legitimate reason, including:
product unavailability;
an obvious pricing error;
incorrect product information;
payment failure;
suspected fraud;
inability to deliver to the specified location;
legal or regulatory restrictions.
If Reformer Infinity cancels an order after payment has been collected, the amount paid for the cancelled products will be refunded.
Mandatory consumer rights remain unaffected.
7. Product Availability
Products are subject to availability.
A product appearing as available on the website may occasionally become unavailable before an order is processed because of inventory synchronisation, technical errors, damaged stock or other circumstances.
If an ordered product becomes unavailable, Reformer Infinity may:
offer an alternative product;
provide an updated estimated availability date; or
cancel the affected product and issue a refund.
A replacement product will not be supplied without the customer's agreement.
8. Prices
Prices are displayed in the currency applicable to the customer's selected market.
European customers may be shown prices in:
EUR (€)
Customers in the Kingdom of Saudi Arabia may be shown prices in:
Saudi Riyal (SAR)
The currency applicable to an order is shown before the order is submitted.
The final amount payable is displayed during checkout before the customer confirms the order.
Where required, the total will include or separately identify applicable:
taxes;
VAT;
delivery charges;
other charges collected by Reformer Infinity.
9. Currency Conversion
Where the customer's bank, card issuer or payment provider performs currency conversion, the payment provider may apply its own:
exchange rate;
currency-conversion fee;
international transaction fee.
Such third-party charges are outside the control of Reformer Infinity.
10. Taxes, VAT, Customs and Import Charges
International orders may be subject to:
VAT;
customs duties;
import taxes;
customs-clearance charges;
other governmental charges
depending on the delivery destination and shipping arrangement.
Where duties and taxes are included in the purchase price or delivery service, this will be indicated during checkout or in the applicable delivery information.
Where duties, import VAT or similar governmental charges are not included, the customer may be required to pay them separately upon importation where legally applicable.
Applicable information concerning additional charges will be provided before purchase where required by law.
Customers must provide accurate information reasonably necessary for customs clearance.
11. Payment
Available payment methods are displayed during checkout.
Payments may be processed by independent payment-service providers.
The customer must be authorised to use the selected payment method.
Reformer Infinity may delay dispatch until payment has been successfully authorised or received.
Payment providers may conduct:
payment authentication;
fraud checks;
security checks;
regulatory checks.
The processing of personal data by payment providers is addressed in the Reformer Infinity Privacy Policy and the relevant provider's privacy information.
12. Electronic Order Confirmation and Invoice
Order information is provided electronically.
Depending on the applicable transaction, the order confirmation or invoice may include:
seller information;
customer information;
products ordered;
quantities;
product prices;
discounts;
applicable taxes;
delivery charges;
total amount;
payment information;
delivery information;
order number.
Customers should retain their order confirmation and invoice.
13. Delivery
Available delivery methods, delivery charges and estimated delivery periods are displayed during checkout or in the Shipping & Delivery Policy.
Large Pilates reformers may require:
pallet delivery;
freight delivery;
specialised transport;
scheduled delivery.
Delivery periods shown on the website are estimates unless a specific guaranteed delivery date has expressly been agreed.
Where mandatory consumer law establishes a delivery period, that statutory requirement remains applicable.
For EU consumers, where no different delivery period has been agreed, goods should be delivered within the period required by applicable EU consumer law.
14. Delivery of Large Equipment
Unless expressly stated otherwise, standard reformer delivery does not automatically include:
assembly;
installation;
carrying the reformer upstairs;
carrying the reformer through restricted access;
positioning the reformer in a particular room;
removal of packaging;
removal of an existing reformer.
The precise scope of the selected delivery service will be stated before purchase or in the Shipping & Delivery Policy.
The customer must ensure that an authorised person is available to accept a scheduled freight delivery where required.
15. Incorrect Address and Failed Delivery
Customers must provide complete and accurate delivery information.
Where legally permitted, reasonable additional costs caused by:
an incorrect address;
incomplete delivery information;
refusal of delivery without legal justification;
repeated unsuccessful delivery attempts;
failure to attend a scheduled freight delivery
may be charged to the customer.
This section does not apply where failed delivery is caused by Reformer Infinity or its delivery provider.
16. Risk During Delivery
For consumer purchases, risk of accidental loss or damage generally remains with Reformer Infinity until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the products.
Where the customer independently appoints a carrier that was not offered by Reformer Infinity, different statutory rules may apply.
Mandatory consumer rights remain unaffected.
17. Transport Damage
Customers are encouraged to inspect deliveries as soon as reasonably possible.
If packaging or a product shows visible transport damage, customers are encouraged to:
photograph the packaging;
photograph the damage;
retain the packaging;
note visible damage with the carrier where possible;
contact Reformer Infinity promptly.

A prompt report helps Reformer Infinity investigate the damage with the carrier.
Failure to report transport damage immediately does not remove mandatory statutory consumer rights.
18. Order Cancellation Before Dispatch
Customers wishing to cancel an order before dispatch should contact:

as soon as possible.
Where cancellation is still operationally possible, Reformer Infinity may cancel the order and issue the applicable refund.
If the order has already entered fulfilment or has been dispatched, the applicable statutory withdrawal or return rules may instead apply.
19. EU/EEA Consumers – Right of Withdrawal
Consumers in the European Union and, where applicable, the European Economic Area have a statutory right to withdraw from qualifying distance contracts without giving a reason.
The withdrawal period is generally 14 days.
For goods, the withdrawal period begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods.
Where multiple goods from one order are delivered separately, the period generally begins when the final applicable item is received.
To exercise the right of withdrawal, the customer must inform Reformer Infinity of the decision to withdraw before the withdrawal period expires.
The notification must contain a clear statement of the decision to withdraw.

The model withdrawal form at the end of these Terms may be used but is not mandatory.
20. EU/EEA Return Deadline Following Withdrawal
After exercising the statutory right of withdrawal, the consumer must return the goods without undue delay and generally no later than 14 days after informing Reformer Infinity of the withdrawal, unless Reformer Infinity has agreed to collect the goods.
Customers must contact Reformer Infinity for appropriate return instructions before sending a large reformer or freight shipment.
Products should be returned with all components and accessories supplied with them.
21. EU/EEA Return Costs
Unless Reformer Infinity expressly offers free returns, the consumer bears the direct cost of returning goods when exercising the statutory change-of-mind withdrawal right, provided the consumer was properly informed of this obligation before purchase.
Small products capable of being returned by ordinary parcel services may be returned using an appropriate delivery service.
Pilates reformers and other large products normally require specialised freight transportation.
For goods that cannot normally be returned by post, the estimated direct return transport cost is provided to the customer before the purchase is concluded, including through the relevant product information, Shipping & Delivery Policy or Return & Refund Policy.
Return freight costs for large Pilates reformers can be substantially higher than ordinary parcel-return costs because of their size, weight, packaging and collection requirements.
Where Reformer Infinity arranges collection at the customer's request for a change-of-mind return, the applicable collection cost may be deducted from the refund where permitted by law and where the customer has been appropriately informed.
22. EU/EEA Refund Following Withdrawal
Where a consumer validly exercises the statutory right of withdrawal, Reformer Infinity will reimburse payments required to be reimbursed under applicable law.
This normally includes the cost of the least expensive standard delivery method offered for the original purchase.
Additional costs resulting from the customer's choice of a more expensive delivery method, such as premium or express delivery, do not have to be reimbursed to the extent permitted by law.
Refunds will be processed without undue delay and within the statutory period.
Reformer Infinity may withhold reimbursement until:
the returned goods have been received; or
the consumer provides evidence that the goods have been sent back,
whichever occurs first, where permitted by applicable law.
Refunds will normally be made using the same payment method used for the original purchase unless another method has been expressly agreed.
23. EU/EEA Handling and Diminished Value
Consumers may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning.
A consumer may be responsible for diminished value resulting from handling beyond what is necessary for such an inspection.
For a Pilates reformer, excessive handling may include, depending on the circumstances:
repeated training sessions;
prolonged use;
commercial studio use;
staining;
scratching;
physical damage;
unauthorised modifications;
damage caused during unnecessary assembly or disassembly.
Any deduction for diminished value will be made only to the extent permitted by applicable consumer law.
24. EU/EEA Exceptions to the Right of Withdrawal
The statutory withdrawal right does not apply where an exception provided by applicable law applies.
This may include goods that are:
made to the consumer's individual specifications; or
clearly personalised.
For example, a genuinely bespoke reformer made specifically according to individually requested specifications, custom dimensions, personalised branding or other unique customer requirements may qualify for the exception.
Simply selecting from standard options normally offered by Reformer Infinity, such as standard colours or standard configurations, does not automatically make a product individually customised for this purpose.
Where another statutory withdrawal exception applies, it will be applied only to the extent permitted by law.
Withdrawal exclusions do not remove rights concerning defective or non-conforming products.
25. EU/EEA Legal Guarantee
Consumers protected by EU consumer law benefit from the mandatory legal guarantee applicable to goods.
New goods sold to EU consumers have a minimum two-year legal guarantee against lack of conformity, without prejudice to longer protection provided under the national law of a particular country.
A product should:
correspond to its description;
possess the agreed characteristics;
be suitable for its normal purpose;
meet the quality and functionality reasonably expected under applicable law.
Where goods are defective or do not conform to the contract, the consumer may have statutory rights including:
repair;
replacement;
price reduction;
termination of the contract and refund
depending on the circumstances and applicable law.
Any manufacturer's warranty or voluntary commercial warranty is additional to mandatory statutory rights and does not replace them.
26. Defects, Misuse and Normal Wear
A defect covered by statutory rights is different from deterioration caused by circumstances arising after delivery.
Subject to applicable law, damage caused solely by matters such as the following is not automatically a manufacturing defect:
improper use;
failure to follow safety instructions;
incorrect assembly by the customer;
unauthorised modification;
accidents;
excessive loads outside product specifications;
unsuitable storage;
improper maintenance;
ordinary wear of consumable or wear components.
This section does not restrict statutory rights relating to defects or non-conformity existing at the legally relevant time.
27. Saudi Arabia – Seven-Day Right to Rescind
Where the Saudi E-Commerce Law applies, a consumer may rescind a qualifying ecommerce contract within seven days following receipt of the product, provided that:
the product has not been used;
the consumer has not benefited from the product; and
no statutory exception applies.
Unless otherwise agreed, the consumer bears the costs resulting from exercising this change-of-mind rescission right.

This section does not affect rights relating to defective or non-conforming products.
28. Saudi Arabia – Exceptions to the Seven-Day Right
The statutory seven-day rescission right does not apply where an exception under Saudi E-Commerce Law applies.
In particular, the right may not apply to products:
manufactured specifically at the customer's request; or
manufactured according to specifications individually determined by the customer.
This exception does not apply to a customised product where the product is defective or does not conform to the agreed specifications.
Other statutory exceptions remain applicable where relevant.
29. Saudi Arabia – Delivery Delay
Unless Reformer Infinity and the consumer have agreed another delivery period, Saudi consumers may have the statutory right to terminate the contract where delivery is delayed for more than 15 days from:
the date the contract was concluded; or
the agreed delivery date,
as applicable.
Where the statutory conditions are satisfied, the consumer may recover amounts paid in accordance with applicable Saudi law.
This right is subject to applicable statutory exceptions, including force majeure.
Reformer Infinity will provide information concerning anticipated material delivery delays where required by applicable law.
30. Saudi Arabia – Defective or Non-Conforming Products
The seven-day change-of-mind right is separate from rights concerning:
defective goods;
goods that do not conform to the agreed specifications;
incorrect products;
applicable warranty rights.
Expiration of the seven-day rescission period does not remove mandatory rights that may exist for defective or non-conforming goods.
Any voluntary commercial or manufacturer's warranty is additional to mandatory rights and does not replace them.
31. Custom-Made and Personalised Reformers
Certain reformers may be offered with genuinely individual specifications.
Examples may include:
individually requested dimensions;
personalised logos;
bespoke branding;
individually specified upholstery;
unique finishes not forming part of the standard offer;
other individually manufactured features.
Where a product is genuinely manufactured according to an individual customer's specifications, statutory change-of-mind cancellation rights may be excluded where applicable law permits such an exception.
Customers will be informed before completing the purchase where the custom nature of a product affects statutory withdrawal rights.
This does not limit rights where the product is defective or fails to meet agreed specifications.
32. Returns of Large and Bulky Products
Pilates reformers should not be returned without first obtaining return instructions from Reformer Infinity.

appropriate protective packaging;
palletisation;
freight collection;
specialist transportation.
Unauthorised freight returns may be refused by a logistics facility where no arrangements have been made to receive the shipment.
Where the customer is legally responsible for organising the return, the product must be packaged appropriately for transport.
The customer's responsibility for return transportation does not limit Reformer Infinity's obligations where the goods are defective or where applicable law requires Reformer Infinity to bear return or remedy costs.
33. Packaging for Returns
Customers should retain suitable product packaging until they are reasonably satisfied with the delivered equipment.
Original packaging is particularly useful for safe transportation of large reformers.
The absence of original packaging does not automatically remove a statutory withdrawal or warranty right.
However, where a customer is responsible for arranging a return, the customer must take reasonable steps to protect the product from avoidable transport damage.
34. Assembly and Installation
Certain reformers require assembly or adjustment before use.
Customers must follow:
the supplied assembly instructions;
operating instructions;
safety instructions;
maintenance instructions.
Unless expressly stated otherwise, assembly or installation is not included in the product price.
Where Reformer Infinity separately offers an assembly or installation service, the scope and price of that service will be disclosed before purchase.
35. Safe Use of Pilates Equipment
Pilates reformers and accessories must be used for their intended purpose and in accordance with applicable product instructions.
Before use, equipment should be checked as appropriate for visible damage or abnormal operation.
Components that may require regular inspection include:
springs;
ropes;
straps;
pulleys;
carriages;
footbars;
fasteners;
connectors;
other moving or load-bearing components.
Damaged equipment should not be used until the relevant issue has been assessed or corrected.
Children should not use or play with Pilates reformers without appropriate supervision.
Commercial operators are responsible for appropriate inspection and maintenance procedures for equipment used in a professional environment.
Nothing in this section removes liability that cannot legally be excluded.
36. Maintenance and Wear Parts
Certain components of Pilates equipment are subject to normal wear through regular use.
Depending on the product, these may include:
ropes;
straps;
loops;
springs;
upholstery;
wheels;
bearings;
pads;
other moving or contact components.
Customers should follow maintenance and inspection intervals contained in the relevant product documentation.
Normal wear and tear is distinct from a defect or lack of conformity, subject to applicable law.
37. Commercial and Manufacturer Warranties
A product may be supplied with a voluntary commercial or manufacturer's warranty.
Where applicable, warranty information will be stated:
on the product page;
in documentation supplied with the product; or
in the Warranty Policy.
Commercial warranty terms may specify:
warranty duration;
covered components;
conditions;
geographical limitations;
commercial-use conditions.
A voluntary warranty does not replace or reduce mandatory statutory consumer rights.
38. Promotions and Discount Codes
Promotions and discount codes may be subject to additional conditions displayed with the relevant offer.
Unless otherwise stated:
promotional codes have no cash value;
codes may be limited to certain products;
codes may have expiry dates;
only one promotional code may be accepted per order.
Reformer Infinity may correct or cancel a promotion affected by an obvious technical or pricing error, subject to applicable consumer law.
39. Website Privacy and Personal Data
Personal data is processed in accordance with the Reformer Infinity Privacy Policy.
The online store is operated using Shopify and uses privacy and consent-management technologies including Pandectes GDPR Compliance.
Depending on the customer's location and consent choices, the website may also use technologies and services including:
Google Analytics;
Google Ads;
Meta Pixel;
TikTok Pixel.
These technologies may be used for purposes including:
website analytics;
conversion measurement;
advertising measurement;
marketing attribution;
remarketing;
advertising personalisation where permitted.

40. Cookies and Consent
The website uses strictly necessary cookies and may also use optional analytics, advertising and marketing cookies or similar technologies.
Where applicable law requires consent, optional analytics and advertising technologies are used according to the visitor's consent preferences.
Cookie preferences are managed through the website's consent-management system provided through Pandectes GDPR Compliance.
Customers may accept, reject or manage applicable cookie categories through the available cookie settings.
Acceptance of these Terms and Conditions does not constitute consent to optional analytics, advertising or marketing cookies.
Consent to non-essential tracking is requested and managed separately.

41. Google, Meta and TikTok Advertising
Where legally permitted and subject to applicable consent requirements, Reformer Infinity may use Google, Meta and TikTok advertising technologies for:
advertising measurement;
conversion tracking;
campaign optimisation;
audience measurement;
remarketing;
personalised advertising.
Use of these technologies does not alter the customer's contractual consumer rights.
Customers can manage applicable tracking preferences through the website's cookie settings.
42. Intellectual Property
Unless otherwise stated, website content including:
trademarks;
logos;
product photographs;
graphics;
designs;
written content;
product descriptions;
website materials
is owned by or licensed to Reformer Infinity.
Such content may not be reproduced, distributed, modified or commercially exploited without permission except where permitted by law.
43. Customer Reviews and Submitted Content
Where customers submit product reviews, photographs or other content, they must ensure that they have the right to submit that material.
Submitted content must not:
infringe third-party intellectual-property rights;
contain unlawful content;
contain intentionally false or misleading information;
violate the privacy rights of another person.
Reformer Infinity may moderate or remove content where reasonably necessary or legally required.
44. Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms excludes mandatory liability relating to:
death or personal injury where liability cannot legally be excluded;
fraud or fraudulent misrepresentation;
mandatory product liability;
mandatory consumer rights;
other liability that cannot legally be excluded.
For consumers, any limitation of liability applies only to the extent permitted by applicable consumer law.
45. Business Customer Liability
For business customers only, and to the maximum extent permitted by applicable law, Reformer Infinity will not be liable for indirect or consequential business losses such as:
loss of profit;
loss of revenue;
loss of business opportunity;
loss of anticipated savings;
business interruption
except where such liability cannot legally be excluded.
This limitation does not apply to consumers where prohibited by applicable consumer law.
46. Force Majeure
Reformer Infinity is not responsible for delay or failure caused by circumstances outside its reasonable control to the extent permitted by law.
Such circumstances may include:
natural disasters;
extreme weather;
war;
civil unrest;
government restrictions;
customs disruptions;
port closures;
transport interruptions;
major infrastructure failures;
strikes;
epidemics;
comparable events beyond reasonable control.
Where such circumstances materially affect an order, reasonable steps will be taken to inform the customer.
Mandatory statutory rights relating to cancellation, delivery and refunds remain unaffected.

49. Alternative Dispute Resolution
Where applicable law provides consumers with access to an authorised alternative dispute-resolution mechanism, those statutory rights remain unaffected.
Reformer Infinity will seek to resolve customer complaints directly where reasonably possible.
Reformer Infinity does not undertake to participate in a particular voluntary alternative dispute-resolution procedure unless such participation is legally required or expressly agreed.
50. Governing Law
Except where mandatory consumer law provides otherwise, contracts concluded with Reformer Infinity - FZCO are governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai.
This choice of law does not deprive a consumer of mandatory legal protections that would otherwise apply.
In particular:
consumers in the European Union retain mandatory consumer protections applicable under EU and relevant national law where those protections apply;
consumers in Saudi Arabia retain mandatory protections applicable under Saudi law where those protections apply.
Nothing in these Terms requires a consumer to waive a mandatory right concerning applicable law or jurisdiction.

Where mandatory consumer law gives a consumer the right to bring proceedings before particular courts, those rights remain unaffected.
For business-to-business transactions, the competent courts of Dubai, United Arab Emirates may have jurisdiction where legally permissible and unless otherwise agreed in writing.
52. Changes to These Terms
Reformer Infinity may update these Terms from time to time to reflect:
changes in law;
changes in products;
changes in delivery arrangements;
changes in payment services;
changes in website functionality;
changes in business operations.
The Terms applicable to an order are normally the version in effect when the order is placed.
Later changes will not retroactively reduce mandatory rights relating to an existing order.
53. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the maximum extent legally permissible.
Where necessary, the affected provision will be severed.
The remaining provisions will continue to apply.
54. No Waiver of Statutory Rights
A failure by Reformer Infinity to enforce a contractual right immediately does not constitute a waiver of that right.
Nothing in these Terms constitutes a waiver by the customer of mandatory statutory consumer rights.
